When the Center for Equal Opportunity was founded more than 30 years ago, we took a clear, principled stand against an injustice that few in Washington were willing to challenge: perpetual federal court oversight of local school districts through decades-old desegregation consent decrees.
Back in the 1990s, CEO undertook a groundbreaking analysis on School Desegregation and began sending formal complaints to hundreds of federal judges across the country, urging an end to these outdated judicial mandates. We argued that federal oversight was never intended to be permanent, that local districts must be allowed to govern themselves, and that true equal protection requires returning control to local communities under colorblind principles. We continued applying this pressure over the years and never stopped.
Throughout our decades of commentary, CEO continuously pushed back against media narratives—including front-page claims in major outlets like The Washington Post accusing districts of “resegregation” whenever court supervision was challenged. We exposed how perpetual court oversight forced districts into artificial racial balancing rather than focusing on educational excellence, maintaining that normal neighborhood housing patterns should never be confused with state-sponsored discrimination.
Now, more than a quarter-century later, the U.S. Department of Justice has vindicated CEO’s long-standing position.
In a landmark decision, the Justice Department announced the termination of over 50 half-century-old desegregation cases nationwide. In doing so, federal officials echoed the exact principles CEO has championed all these years—noting that these 50- to 60-year-old federal decrees no longer reflect the reality of today’s classrooms and that ending prolonged oversight allows taxpayer dollars to directly benefit students rather than funding endless legal bureaucracy.
